Right of Access: Empowering Patients to be Involved in Their Healthcare Decisions

Overview

Right of access is not only a regulatory requirement under HIPAA, it is also a mechanism which empowers patients to be involved with their own healthcare. Research demonstrates that individuals with access to their health information are better able to monitor chronic conditions, adhere to treatment plans, identify and correct errors in their health records, and track progress in wellness or disease management programs. An organization’s HIM function plays a key role in enhancing patients’ right of access and assuring that access is in compliance with the regulatory requirements of both HIPAA and the Cures Act. For example, the HIM function can assist with establishing an organization’s policies and procedures for responses to patient requests for records to ensure that patient requests are being handled compliantly, consistently and timely in accordance with regulatory deadlines and requirements. Additionally, potential risks for non-compliance with right of access requirements can be identified, which will allow for proactive remediation by the organization. With the ever-increasing scrutiny on the ability of patients to obtain their medical records/health information, organizations will need to utilize the HIM function in order to continue to remain apprised of potential issues surrounding their ability to comply with the right of access requirements, as well as to keep leadership informed of the same.

Objectives

  • Understand why access to protected health information is important for patient decision-making.
  • Describe the regulatory requirements around the Access Initiative (including the Cures Act, Exceptions, Information Blocking Tools and the Privacy Rule).
  • Develop processes to ensure patient access to PHI is compliant and fulfilling patient and caregiver expectations.
  • Report to leadership the status of patient access to PHI for assurance of meeting regulatory requirements and achieving strategic organizational objectives.
